Terms and Conditions

Now we know you're nice people, and that you would never do any of the things listed here anyway. Sadly, we do have to write it down and ask you to agree with it, just so we have some leverage to deal with the occasional troublemaker who may turn up. Let's hope they don't eh?

Our hosting company insists, quite rightly, that we comply with some perfectly reasonable rules regarding content.

• Illegal use: our services may not be used for illegal purposes, or in support of illegal activities. We reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.
• Harm to minors: Use of the service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography.
• Threats: Use of the service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
• Harassment: Use of the service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.
• Copyright or trademark infringement: Use of the service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
• Fraud: Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.
• Pornography: It is absolutely forbidden to host pornographic content.

We don't think that they're asking too much here, and the site could get shut down if we violate these rules, so please stick to them. There are also a couple of rules of our own we'd ask you to observe:

• As a guideline for image content, we ask you to remember that many people access this site from work, or with their family present. Please make sure images/videos are "safe for work/kids".
• The posting of dodgy code (javascript etc) in your blogs which opens pop-up windows, resizes the browser, captures data or otherwise causes an annoyance is forbidden.
• Obviously, any attempt to post to, edit or otherwise tamper with another user's moblog is right out of order, and will be dealt with accordingly.

We also reserve the right to suspend, halt or otherwise interrupt the service, either for maintenance or any other reason. Obviously, we won't be doing this unless we absolutely have to, and we will do our best to let you know of any downtime in advance.

We hope that these rules don't get in the way of your moblogging - we tried to keep them as short as we could. Remember, we do reserve the right to terminate your account and/or ban you from the site if we have to. We're nice people really, but you wouldn't like us when we're angry..

A note about copyright

The last thing we want to do is to take ownership of your images - they're yours to do with as you wish, and if we want to use them, we'll ask you first. If you don't like the idea of full copyright, might we suggest a creative commons license. Creative commons allows you to protect your images from theft, but in a less restrictive way than a full copyright. For instance, you could allow some to use your images for personal use, whilst protecting your rights for commercial use.

If, after finding out which license is best for you, you wish to use one, you'll find a handy 'license wizard' in your moblog settings page.

Commercial use

Moblogs may not be set up on moblog.net servers that will be used for commercial purposes including but not limited to promotion of a commercial product or service. Moblog offers a commercial service, for more information on using Moblog commercially, please see moblogtech.com
